Announcement of Proposed System Acquisition Plan

I am pleased to announce the following weapons system purchase plan in accordance with Article 8(bidding) of the Act on contracts Which the State is a Party and Article 213(weapon system purchase bidding) of the Defense Acquisition Program Management Regulation.

▣ Project Title: Maritime Operations Helicopter

▣ Project Description
   A program that purchase the maritime operations helicopter that ROKN will operate.

▣ Qualification for Bidding Participation
   ❍ The participant must be qualified under Article 12 of the Enforcement Decree of the Act on contracts which the State is a Party. The participant must be not restricted by Article 76 there of.
   ❍ The participant must be not restricted by Article 70 of the Enforcement Decree of the Defense Aquisition Program Act.
   ❍ International manufacturers or suppliers for the weapon system

▣ Participation in the Program Explanatory Session
   ❍ Registration submission deadline : January 13(Fri), 2012 12:00
   ❍ Registration method : e-mail or FAX (No mail)
   ❍ Notes
      • Participation of explanatory session
         - companies that which satisfy all the qualifications for Participation above, their  Commission agents, if any, and Representing agents, if any
         - government personnel that which satisfy all the qualifications for Participation above
      • All participants in the explanatory session are required to submit their company name, job title, name, nationality, birth date(or passport number), and phone number(cell phone number) for entrance to DAPA. via FAX or e-mail by aforementioned date to DAPA/MAIPT.
         ※ Cars are not allowed to enter to DAPA on the day of the explanatory session.
      • Participation in the explanatory session is limited to the companies that registered previously.

▣ Explanatory Session
   ❍ Date/Location : January 17(Tue), 2012 14:00~16:00/DAPA Conference room
   ❍ Contents
      • Detailed information of RFP and distribution
         ※ Distribution of RFP will be limited to the explanatory session participants at the site, and according to Article 43 of the Enforcement Decree of the Act on contracts which the state is a Party, only those who participate in the explanatory session can participate in this program.

▣ Contract and Source Selection
   ❍ Contract Type: Open competition
   ❍ Source Selection(Contract company selection)
      • The source will be selected by evaluating the proposals of the proposing companies qualified to participate. DAPA will conduct T&E and negotiation on selected system(s)
      • Once negotiations and T&E are completed, overall assessment method will be applied to select the source.

▣ Proposal submission (Bidding registration deadline)
   ❍ Date : May 10(Thu), 2012 15:00
   ❍ Location : DAPA Customer Service Center
   ❍ Submission method : On site submission(No mail)
   ❍ Required documents
 1. Manufacturer
    a. Proposal and other required documents(Refer to RFP for more details)
    b. One copy of Foreign Procurement Registration Certificate issued by DAPA
    c. One original copy of proof of the manufacturer(notarized)
    d. Documents reflecting to the deposit of the security for a tender    (Refer to Bid-Bond and a guideline on Reversion)
 2. Supplier
    a. Proposal and other required documents(Refer to RFP for more details)
    b. One copy of Foreign Procurement Registration Certificate issued by DAPA
    c. One original copy of proof of the manufacturer(notarized)
    d. One original copy of proof of the supplier(notarized)
    e. Documents reflecting to the deposit of the security for a tender    (Refer to Bid-Bond and a guideline on Reversion)
 3. Domestic(Korea) Commission agency
    a. In case a agent is acting on behalf of the Participant, a Foreign Manufacturer or Supplier, he/she shall submit the Power of Attorney issued by the company representative, including the above described Article 1.(or 2.).
    b. One copy of the agency contract between the agent and the manufacturer(supplier)
    c. A certificate of a seal impression of representative

▣ Bid-Bond and a guideline on Reversion
   ❍ The qualified proposing entity shall prepare 5% of the proposed price as bid-bond to guarantee implementation of its obligations.
   ❍ The Proposing entity may be exempted from the bid-bond requirement if the followings provisions do not apply. However, even if exempted, the qualified proposing entity shall still submit the memorandum of payment for bid bond pursuant to Article 37(4) of Enforcement Decree of the Act on contracts to which the State is a Party.

      ① An entity which has not yet made a payment due for reversion to DAPA
      ② An entity which is currently prohibited from entering into an agreement with DAPA under Article 27 of the Act on contracts which the State is a Party, and Article 76 of the Enforcement Decree of the Act on contract which the State is a Party.
      ③ A company which was formed less than one(1) year from the date of registration submission deadline.
   ❍ If the successful bidder fails to enter the contract by the appointed date, the Bid-Bond will come under jurisdiction of the Nation by Article 9 of the Act on contracts Which the State is a Party and Article 38 of the Enforcement Decree of the Act on contracts to which the State is a Party.

▣ Nullity of the Bidding
   Bidding, which falls under Enforcement Decree of the Act on Contracts to which the State is a Party Article 39 Item 4, Enforcement regulation Article 44, and Commodity Purchase(Manufacturing) Bidders ANNEXES(Accounting regulation 2200.04-101-11, 2010.4.15) article 12 is considered invalid.

▣ Other Bidding requirements
   ❍ Bidding participants(company) shall submit an oath for fulfilling clean contract. The bidder shall have full knowledge of clean contract special conditions, and clean contract oath document and the special conditions can be found at DAPA customer service center or downloaded at official  website(http://www.d2b.go.kr).
   ❍ The bidder shall have full knowledge of bidding documents, and the bidder will be responsible for not knowing such information.
   ❍ If interpretation of Korean and English language differs, the interpretation and meaning of Korean language shall have higher priority.
