Announcement of Proposed System Acquisition Plan

I am pleased to announce the following weapon system purchase plan in accordance with Article 8 of the Act on Contracts to Which the State is a Party and Article 213 of the Defense Acquisition Program Management Regulation 158.

▣ Project Title : Next Fighter(F-X) Program

▣ Project Description
   Procurement of ROKAF's Next Fighter(F-X)

▣ Qualification for Bidding Participation
   ❍ A participant that is qualified under Article 12 of the Enforcement Decree of the Act on Contracts to Which the State is a Party and who is not restricted by Article 76 of the foregoing Enforcement Decree.
   ❍ A participant who is not restricted by Article 70 of the Enforcement Decree of the Defense Aquisition Program Act.
   ❍ A manufacturer(s) who is capable of providing the F-X as it is requested in the RFP.
   ❍ The government of where the above manufacturer's headquarters is located.

▣ Participation in the Program Explanatory Session
   ❍ Registration deadline : 27 January, 2012 (15:00)
   ❍ Registration method : e-mail or FAX(No mail)
   ❍ Notice
      • Qualified participants for the explanatory session
         - companies that satisfy all of the above qualifications for participation (The employed trade commission agent of the company may also participate)
         - A government employee who satisfies all of the above qualifications for participation
      • All participants in the explanatory session are required to submit their company name, position title, name, nationality, date of birth(or passport number), and phone number(or cell phone number) for his/her entrance to DAPA and prior security clearance, via FAX or e-mail by the aforementioned date to DAPA(Fighter Project Team).
         ※ Participation to the explanatory session is limited to pre-registered personnel only and if a person(s) that had not registered wishes to attend on the day of the session, the person shall have sufficient proof that he or she is currently an employ of the corresponding company(Certification of Employment, Employee ID card, etc). Also, vehicles shall not be allowed to enter DAPA on the day of the explanatory session.

   ❍ Date/Location : 30 January, 2012 (14:00~16:00)/DAPA Conference Room
   ❍ Contents
      • Explanation and distribution of RFP
         ※Distribution of RFP shall be limited to the participants of the explanatory session, and according to Article 43 of the Enforcement Decree of the Act on Contracts to Which the State is a Party, and only those who participate in the explanatory session are eligible to participate in this program.

▣ Contracting and Source Selection Method
   ❍ Contract Type : Open competition
   ❍ Source Selection(contractor selection)
      • The companies' proposals shall first be evaluated to select the eligible entities. DAPA shall then conduct T&E and negotiations on the selected system(s).
      • Once negotiations and T&E are completed, a source(contractor) shall be selected via a Comprehensive Evaluation Technique.

▣ Proposal Submission(Bidding Registration Deadline)
   ❍ Date : June 18(Mon), 2012 15:00
   ❍ Location : DAPA Customer Service Center
   ❍ Submission method : On site submission(No mail)
   ❍ Required documents
 1. Manufacturer
    a. The proposal and other documents(Refer to RFP for more details)
    b. One copy of Foreign Procurement Registration Certificate issued by DAPA
    c. One original copy of Proof of the Manufacturer(notarized)
    d. Bid Bond documents under the name of the qualified company(See "Bid-Bond and Reversion Guideline")
 2. Domestic(Korea) trade commission agency
    a. An original copy of Power of Attorney issued by the company representative, including the documents of the aforementioned Article 1.(or 2.).
    b. One copy of the agency contract document signed between the trade commission agency and the manufacturer
    c. A certificate of the trade commission agency representative's seal impression
※ Foreign government participation
    a. The proposal and other documents(Refer to RFP for more details)
    b. One original copy of Proof of the Manufacturer(notarized)
    c. One copy of the documents relevant to Bid-Bond payment, under the name of a foreign government or the manufacturer

▣ Bid-Bond and Reversion Guideline
   ❍ Entities qualified for participation shall prepare 5% of the proposed price or more as the bid-bond to guarantee the implementation of its obligation when submitting the proposal.
   ❍ The proposing entity may be exempted from the bid-bond requirement if the following provisions do not apply. When exempt, the qualified proposing entity shall submit a Memorandum of Payment for Bid-Bond under the name of the proposing entity pursuant to Paragraph 4, Article 37 of Enforcement Decree of the Act on Contracts to Which the State is a Party.
      ① An entity who has not yet made a payment due for reversion to DAPA
      ② An entity who is currently prohibited from entering into an agreement with DAPA under Article 27 of the Act on Contracts to Which the State is a Party, and Article 76 of the foregoing Enforcement Decree.
 ③ An entity who was formed less than one(1) year from the date of registration deadline
   ❍ If the successful bidder fails to conclude the contract by the appointed date, the Bid-Bond shall come under the jurisdiction of the Nation by Article 9 of the Act on Contracts to Which the State is a Party and Article 38 of the foregoing Enforcement Decree.

▣ Invalidation of the Bidding
   A Bidding which falls under Enforcement Decree of the Act on Contracts to Which the State is a Party Paragraph 4, Article 39 and Enforcement Regulation Article 44, and Commodity Purchase(Manufacturing) Bidders Annexes(Accounting Regulation 2200.04-101-11, 2010.4.15) Article 12 shall be considered invalid.

▣ Other Bidding Requirements
   ❍ Bidding participants(company) shall submit an oath of fulfilling a clean contract. The bidder shall have full knowledge of the clean contract special conditions, and the clean contract oath document. The special conditions can be found at DAPA Customer Service Center or downloaded at our official website(http://www.g2b.go.kr).
   ❍ The bidder shall have full knowledge of bidding documents, and the bidder shall be responsible for ignorance of such information.
   ❍ If the interpretation of Korean and English language differs, the interpretation and meaning of Korean language shall have the higher priority.
